The Pura Vida Unit Trust mobile message service (the “Service”) is operated by Pura Vida Unit Trust (“Pura Vida Unit Trust”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Pura Vida Unit Trust’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Pura Vida Unit Trust through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
General Terms
This Agreement, together with the Privacy & Cookie Policy or any other legal notices published by Kidneycoach.com on the web page shall constitute the entire agreement between you and Kidneycoach.com concerning use of the web page and the Service. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and Kidneycoach.com failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.
This Agreement is governed by the laws of The United States of America, without regards to its conflict of laws principles, and any dispute arising from this Agreement shall be brought exclusively before the courts of Las Vegas, Nevada, USA. Notwithstanding the foregoing, nothing in this clause shall limit the right of Kidneycoach.com to take proceedings against you in any other court of competent jurisdiction, nor shall the taking of proceedings in any one or more jurisdictions preclude the taking of proceedings in any other jurisdictions, whether concurrently or not, to the extent permitted by the law of such other jurisdiction. You may not transfer or assign your rights or obligations under this Agreement to any third party without the prior written approval of Kidneycoach.com.
Kidneycoach.com may assign this Agreement in whole or in part at its discretion. The English language version of this Agreement shall be the prevailing version in the event of any discrepancy between any translated versions of this Agreement.
